DUBAI, 14th April, 2022 (WAM) — The Ministry of Human Resources and Emiratization has warned national and resident employers and families of the risks of dealing with unlicensed national labor recruitment agencies, including unreliable social media pages that promote the services of this category of workers.

The ministry confirmed that dealing with licensed recruitment agencies guarantees the rights of all parties, in accordance with the Domestic Workers Act and its Regulations, pointing out the intensification of monitoring of licensed recruitment agencies to ensure their legal obligations, in particular in terms of respecting the prices of the packages which are determined by the ministry, according to the recruitment costs of the countries of origin of this category of workers.

He further explained that recruitment offices offer the “traditional package”, in which the worker is registered with the employer and resides with him during the contract period of two years and its duration, which is the period during which the office guarantees the domestic worker, this package therefore allows the employer to replace the worker or recover the recruitment costs in one of the following four cases during the first six months of the contract, which is the period of trial. These cases include: termination of the contract by the worker without a legitimate reason; let him work without an acceptable reason; the fitness level of a health worker; his inability to perform his professional duties in the required and agreed manner.

Part of the recruitment fee is reimbursed if two cases occur during the post-trial period until the expiry date of the two-year contract, both cases involving the termination of the worker’s contract after the probationary period. probation without legitimate reason, or leaving work after the probationary period without an acceptable reason. These reimbursed amounts are based on the remaining period of the contract in months from the total recruitment cost.

Domestic worker recruitment offices also offer a “temporary package” where a trained and qualified assistant is made available within 24 hours, and that worker is registered with the office for a two-year contract period, during which the worker does not is not allowed to relocate, as a resident assistant with the employer. The offices also offer the flexible package, which makes available an assistant registered at the recruitment office to work in a flexible system (hours – days – week – months), and the cost of recruitment depends on the type of employment.

This package includes a set of benefits, including the provision of qualified and trained domestic workers, the number of replacement times is not specified and the period of availability of the worker is a maximum of 24 hours.

The ministry highlighted five risks that national and resident employers and families may be exposed to if they deal with entities that bring in this category of workers without the necessary licenses from the ministry, exposing the employer to legal liability when employs an offending assistant. worker.

The ministry also noted the possibility of the employer and his family contracting infectious diseases, as there is no evidence that the offending assistant is free from these diseases, as well as the possibility that the assistant is a criminal, a wanted person. or involved. in acts contrary to the law. The Ministry indicated that it has sought, during the last period, to diversify the nationalities of domestic workers, who are the most sought after by employers and national and resident families, by concluding cooperation protocols with the countries of dispatch, which would control the recruitment process and guarantee the rights of all parties, as well as the periodic review of the fees according to the recruitment costs of each of these countries.

The nationalities of domestic workers in the UAE are the Philippines, Sri Lanka, Bangladesh, Kenya, Ethiopia, Uganda, Nepal and India. The Ministry affirmed its effort to develop services related to domestic workers to meet the needs and requirements of employers and national and resident families, while facilitating access to the services provided by the Ministry.

In this regard, services are available to cancel and renew the residence permits of domestic workers and to file a complaint regarding their interruption of work, shortening the steps to complete these services, as a first step in the development of all services related to domestic workers, which are available through the ministry’s smart app in the Google Play and Apple stores, on the website www.mohre.gov.ae as well as the call center at the toll-free number 80060.

The employer can complete any of the services for canceling or renewing the domestic worker’s residence permit, or registering a work interruption complaint through the ministry’s smart application without the need to enter the password. password and username, where the employer must enter his identity card number and date of birth, as well as enter the verification code in the image that appears in front of him in the application, where an SMS will be sent to him with an OTP verification code on his mobile number registered with the Federal Authority for Identity and Citizenship.

The employer must enter the verification code sent to him and choose the worker required to perform the service on his file, as well as enter the required data and pay the fees, since the request will be sent directly to the processing authority , and an e-mail will be sent to the employer with the payment receipt and a copy of the notarized contract, in the case of the residence permit renewal service for an auxiliary worker.

The ministry called on employers to enjoy the benefits of paying domestic workers’ wages through the Wage Protection System, as the system enables them to pay wages on time, in the easiest and most efficient way. which preserves their right to prove the payment process.

The Wage Protection Scheme, which is voluntary, allows employers to pay salaries through the scheme, whether through cash transfers to banks and money changers that provide the service, registered and licensed with the Bank. Central United Arab Emirates, or through the smart applications of these agencies, after having contracted with them, in accordance with the procedures followed.

The system includes all categories of domestic work, which include clerk, sailor, housekeeper, cook, caretaker, private driver, shepherd, groomer, falconer, laborer, household, the farmer, the gardener, the private trainer, the private teacher, the private nurse, the special representative and private agricultural engineer.
